What is the difference between a lease break and a sublet?

  • Is your name on the lease, but you want to rent out your room or apartment without ending the lease? That’s a sublet. Your name will remain on the paperwork.
  • If the landlord takes your existing lease and adds the new tenant’s name to the contract, that’s a lease assignment. You no longer need to be involved and the landlord will work directly with the new tenant in your place.
  • If the landlord takes your existing lease and removes your name from the contract altogether (to be replaced by the new tenant’s name), you’ve broken the lease. You’re no longer involved and the landlord will work with the new tenant directly in your place.
